Vijay who later paid the necesary dues and fines levied had further sought the controversial remarks of the judge M. Subramaniam to be removed. The Madras High Court had ruled in favor of the superstar recently.
The division bench of Justice Pushpa Sathyanarayana and Justice Mohammed Shaffiq held that it is difficult to suggest that the petitioner had acted with malafide and with deliberate intention and thus, the observation made by the learned single Judge, apart from being unwarranted, are irrelevant to decide the issue.
Meanwhile in yet another case Vijay had filed a case against the levy of heavy fines of 400 percent on the pending entry tax of another luxury vehicle, a BMW X5 imported from the USA in 2005.
The court passed an interim stay order directing the commercial tax department to stop any action against Vijay since the case for tax exemption is still pending in the courts. Similar orders were also passed for cases against music composer Harris Jayaraj and other businessmen.
