Indians in US Receive 5 Year Employment Authorization Boost

The US will provide five-year job permission cards to non-immigrants, including those seeking green cards. This will assist many US-based Indians. The USCIS has extended the maximum validity of original and renewal Employment authorisation Documents (EADs) for some non-citizens who need employment authorisation to five years.

The federal agency lists asylum seekers, withholding of removal applicants, INA 245 adjustment of status applicants, and suspension of deportation or cancellation of removal applicants. By extending EAD validity to five years, the USCIS hopes to lower the amount of new Forms I-765, Employment Authorization applications, for EAD renewals. The agency said this will reduce processing delays and backlogs. Non-citizens' work authorisation depends on their status, circumstances, and EAD filing category.

If someone receives an EAD based on a five-year pending adjustment of status application and their application is denied, their employment authorization may expire before the date on their EAD. In a new report, over 1.05 million Indians are waiting for an employment-based Green Card, and 400,000 may not acquire the permanent residency permit in the US due to long processing timeframes. David J. Bier of the libertarian Cato Institute found that the backlog of employment-based Green Cards had reached a record 1.8 million cases, with 63% from India and 14% from China.
