The Madurai Bench of the High Court of Madras has quashed a petition filed with it by jailbird Dinakaran seeking more time in filing documents with Election Commission of India (ECI) to file documents in the case relating to the freezing of the ‘Two Leaves’ poll symbol of the erstwhile AIADMK.
A public interest litigation (PIL) petition was filed with the Madurai Bench urging it to take urgent steps in directing the ECI to dispose the case at once. Taking up the petition, the Bench had earlier directed the ECI to wind up its interrogation in the case and take a decision by 31st October.
ECI then directed all the concerned parties to furnish all the relevant affidavits and documents by 29th September. The unified AIADMK led by EPS-OPS filed its documents within the stipulated time but jailbird Dinakaran sought more time to file documents. The ECI summarily rejected his claim and said that it would start its process of interrogation/taking up the claims from 06th October (today).
Dinakaran’s counsel moved the Madurai Bench of the High Court of Madras by filing a petition stating that it needed a further period of ‘4 months’ to file relevant documents and affidavits with the ECI. A Bench comprising Justice Venugopal and Justice Abdul which took up the petition refused to grant the time limit and quashed the petition.
