In a significant ruling that reinforces celebrity rights in the digital age, the Delhi High Court has ruled in favour of Nandamuri Taraka Rama Rao Jr. (Jr NTR), making it clear that his name, image, and identity cannot be used for commercial purposes without consent.
The court was hearing a petition that pointed out the growing misuse of Jr NTR’s name, photographs, titles, and likeness across social media, digital platforms, and e-commerce websites. After examining the issue, the High Court observed that such unauthorized use amounts to a direct violation of the actor’s personality and publicity rights.
According to the court, names such as NTR, Jr NTR, Tarak, as well as popular titles like Young Tiger and Man of Masses, are closely associated with the actor’s public identity. His appearance, style, and overall persona are instantly recognizable and therefore form an integral part of his personality, over which he holds exclusive rights.
The judgment also highlighted Jr NTR’s immense popularity, noting that his name and image immediately bring him to mind among the public, both in India and internationally. For this reason, the court stated that any commercial exploitation of his identity without permission is legally impermissible.
The High Court further directed digital intermediaries to act responsibly. As per existing IT laws and digital media regulations, platforms are required to promptly address complaints and remove infringing content within the prescribed timelines. The ruling also extends to anonymous individuals and unidentified online accounts, warning that they too will be held accountable for violations.
Importantly, the court cautioned against the misuse of AI-generated images, altered photographs, and digitally manipulated content created to profit from the actor’s identity, declaring such practices unlawful.
