Can’t order arrest of H. Raja in Periyar statue case: HC makes it clear

The High Court of Chennai has made it clear that it can’t pass orders urging the State police to arrest BJP’s national general secretary H. Raja under the ‘Goodas’ Act’ for his remarks on demolishing EVR Periyar’s statues in the State.
After winning the recent Tripura Assembly polls, the BJP reportedly demolished Lenin’s statues at some parts of the State. Posting a video on his Facebook account, Raja had reportedly commented: “Times are not far away when similar things are don’t to (EVR) Periyar’s statues in Tamil Nadu as well!” Raja’s posting received huge condemnation from all political parties.
Some parties even demanded Raja’s arrest for creating unrest in the State with his utterances. Raja later admitted that his ‘administrator’ had posted the above-said posting without his knowledge and said he felt bad about what happened. TPDMK’s Anoor Jagadeesan moved the High Court of Madras with a plea to order the State police to take Raja into custody under the Goodas’ Act for fomenting terror.
He also sought a ban on Raja’s entry into the State. Taking up the petition, Justice Ramesh said that the Court can’t order an individual to be arrested under the Goondas’ Act. “Petitioner has moved the Court without giving time to the police to react on his complaint and as such, the petition is dismissed,” the Judge said.
