In an unprecedented press-meet held at the national capital yesterday noon, 4 senior serving Judges of the Supreme Court of India made a series of allegations and complaints against incumbent Chief Justice of India Dipak Misra and said that they wanted justice to prevail at any cost.
Justice Chellameshwar, Justice Ranjan Gogoi, Justice Madan Lokur and Justice Kurien Joseph met the press and vented out their feelings of desperation. “Nothing has been going on well,” Justice Chellameshwar observed and added that a few cases taken to the CJI’s notice in the past few months ended up as colossal failures.
"We submitted a signed letter to the CJI on an important case which hasn't been acted upon as on date. There is a clear bias in allocating cases to Judges. Administration at the top Court in the country is not good and we have no other way of bringing this to people's notice. We met the CJI in this regard but nothing positive has turned up," the Judges told the press. They also expressed their strong objection to the mode of Collagium choosing the Judges to be posted to work at the Supreme Court.
"If such things continue, democracy can't survive in the country," they said, thus sending people into confused and huddled debates of what has been occurring at the apex Court. Following is the gist of what the four Judges told the press:
• This is extraordinary in the history of the nation; it is an extraordinary event in the history of the Constitution. Hallmark of good democracy is an independent judiciary; without it, democracy won't survive;
• The administration of the Supreme Court is not in order and many things less than desirable has happened in the past few months;
• We are left with no choice but talk to the nation directly
• Things less than desirable have happened earlier; we tried to collectively persuade the CJI so that he takes remedial measures but our efforts have failed. Four of us are convinced that for the survival of democracy, an impartial judge and judiciary is needed right now;
• We met the CJI today morning also, but we failed to convince the CJI; we have seen a lot of wise men but we don't want wise men to tell us later after 20 years that the four of us have sold our souls. We construe this as a responsibility to the nation and we have done it;
• We are no one to impeach (when asked if CJI Dipak Misra should be impeached); we have spotted things in the last few months. Tried to intervene but to no avail. Twenty years from now, the nation should not say we sold our souls; and
• Two months back, four of us gave a signed letter to the Chief Justice of India. We wanted a particular thing to be done in a particular manner. But the way it was done, it raised further questions about the integrity of the institution.
