The Madras High Court on Wednesday declined to direct the Salem district police to register a criminal case against Kushboo for her reported comments on the victory of the AIADMK in the recently held Assembly elections.

"Section 504 is non-cognizable offence and it is not even made out in the complaint," Justice T Sudanthiram said and dismissed the petition filed by advocate V Arivalagan, who had leveled against the actress.

According to the advocate, Kushboo had been quoted in a Tamil daily of May 14 as saying that the DMK's defeat in the April 13 elections was not just of the party but of the people of the State, who would face hardships in the next five years while the AIADMK was in power.

Arivalagan contended that the actress's comment was an affront to the entire electorate which had chosen the AIADMK. Instead of waiting for a few months to assess the performance of the ruling party, Kushboo had gone to the press with adverse comments even before the government could be formed, the petitioner said.
